Terms of Use

These terms are an agreement between you and Olympus ML ("we") about your use of the HerpBase app. Using the app means you accept them.
What HerpBase is
A record keeper for people who keep reptiles: what you have, what you fed it, what it weighed, when it shed, what it was treated with. It helps you remember. It does not tell you how to keep animals.
It is not veterinary advice. Nothing in the app — feeding schedules, intervals, reminders, weight trends, genetics predictions — is a clinical recommendation. You are responsible for the welfare of your animals and for consulting a veterinarian when one is needed.
Genetics predictions are probabilities, not promises. Where a trait's inheritance is not known to the app, no prediction is made at all. Where one is made, it is arithmetic on the information you entered — treat it accordingly, especially if money is changing hands.
Your account
You need an account to use HerpBase, created by signing in with Apple or Google. Keep access to that account secure; anyone who can sign into it can see your records. You may install the app on as many of your own devices as you like.
You can delete your account at any time from Profile → Settings → Delete account. This is immediate and permanent — see the Privacy Policy.
Your data is yours
You own everything you put into HerpBase. We claim no rights over it and we do not use it for any purpose other than running the app for you.
You can export all of it at any time, free: Settings → Export full backup for the database and photos, or Export CSV for spreadsheets. We consider this non-negotiable — a record keeper that holds your records hostage is not a record keeper.
What you may not do
- Use the app to break the law. Keeping, selling, importing and advertising exotic animals is regulated, and the rules differ by country — in Portugal, Lei 95/2017 restricts the online sale and advertising of many species. Complying is your responsibility, not the app's.
- Upload content that is unlawful, or that you have no right to upload.
- Attempt to access another user's data, or to interfere with the service.
- Resell or redistribute the app.
Price
Everything in HerpBase is currently free, and no part of the app can be purchased.
If we introduce paid plans in future they will be sold only through the App Store or Google Play, under those stores' terms. Any auto-renewing subscription would renew until you cancel it, and cancellation happens in your Apple or Google account rather than here — we cannot cancel it for you. Prices, terms and any free trial would be shown to you before you buy, and refunds would be handled by Apple and Google under their own policies. Records you have already entered would never become unreadable or unexportable because of a plan change.
Availability, and no warranty
We try to keep the app working and your data safe, but we do not promise the service will be uninterrupted or error-free. The app is provided "as is", without warranties of any kind to the extent the law allows.
Keep your own backups. Export regularly. That is good practice with any app, including ours.
Liability
To the extent permitted by law we are not liable for indirect or consequential losses, for lost profits, or for loss of data beyond what we could reasonably have prevented. Nothing here limits liability that cannot be limited by law — including, if you are a consumer in the EU, your statutory rights, which these terms do not affect.
Ending it
You may stop using HerpBase whenever you like and delete your account from Settings. We may suspend or end an account that breaks these terms, and will tell you why unless the law prevents it.
Changes
We may update these terms. Material changes will be noted in the app's release notes and the date above will change. If you keep using HerpBase afterwards, the new terms apply.
Law
These terms are governed by the laws of Portugal. If you are a consumer you keep the protection of the mandatory laws of the country you live in.
